CONDITIONS OF USE

1. DEFINITIONS

In these conditions of use, the following terms shall mean:

RACC: Reial Automòbil Club de Catalunya, with address at Av. Diagonal, nº 687, Barcelona, registered with the Directorate General for Law and Legal Entities under number 43035 (TIN G-08307928), the company that owns the Portal.

Terms of use: The terms and conditions that regulate the legal relationship between the RACC and the user in their access to and use of the website.

User: Any natural or legal person who accesses and uses the Portal.

2. SERVICE RENDERED

2.1 The service

The service provided by RACC is to offer users access to and use of the Portal to consult the assistance services provided to corporate clients by the RACC Group, as well as to request information about them.

3. RIGHTS AND OBLIGATIONS OF THE USERS

3.1 User responsibility

Users are aware of and voluntarily accept that they use the Portal, in all cases, under their sole and exclusive responsibility.

Users shall be liable for damages of any kind that RACC may suffer as a result of breach of any of the obligations to which they are subject hereunder or by the law in relation to the use of the Portal.

3.2 Compliance with the laws

Users undertake to access and use the Portal in accordance with the law, the conditions of use, and all generally accepted morals and good customs. Likewise, users undertake not to use the Portal for illicit or illegal purposes, or purposes that are harmful to the rights of third parties or which may damage or render useless the Portal or third party rights in any way.

3.3 Non-interference with the Portal

Users expressly represent, warrant and undertake not to send, transmit, distribute or publish material through the Portal that (i) restricts or prevents other users from using and enjoying the Portal; (ii) is unlawful, threatening, abusive, harmful, libellous, defamatory, hateful, racist, obscene, vulgar, offensive, pornographic, religiously disrespectful or indecent; (iii) constitutes or may constitute facts that could give rise to civil or criminal claims; (iv) injures, violates, plagiarises or infringes the rights of third parties, including intellectual property rights; (v) contains viruses or other harmful components that may interrupt, destroy or limit the functioning of any computer software or hardware; (vi) cannot be transmitted by users, and; (vii) is unsolicited or subliminal advertising material, or; (viii) contains false or misleading indications and instructions.

Users expressly represent, warrant and undertake (i) not to interfere with the Portal or servers connected to the Portal and to obey the Portal’s requirements, systems and procedures; (ii) not to gain unauthorised access to other systems through the Portal; (iii) not to influence the Portal in a manner that adversely affects the transactions of other users; (iv) not to threaten or coerce other users; (v) not to store or collect personal or professional data on other users; (vi) not to act falsely and without authorisation for and on behalf of other persons or entities; (vii) not to engage in practices that represent unfair competition.

Users expressly represent, warrant and undertake not to display, sell, transmit, use, store, extract or exploit personal or business names, addresses, telephone and fax numbers, e-mail addresses, listings, prices, fees or any other information relating to the Portal or users.

4. MODIFICATION OF THE TERMS OF USE AND OF THE PORTAL

The RACC may change the total or partial content of the conditions of use available and accessible at the bottom of each page of the Portal at any time. Browsing the Portal implies (i) acceptance of the conditions of use of the Portal and that (ii) said acceptance is permanent, constant and ratified, and shall at all times be understood to refer to the conditions of use in force at any given time.

5. PROPERTY RIGHTS

Users acknowledge and agree that the Portal and any software used in connection therewith contains proprietary and confidential information that is protected by intellectual and industrial property laws. Without the express consent of the RACC, users may not modify, rent, lend, sell, copy, reproduce, transmit, distribute or create derived works based on the Portal or its content. Users may not link the Portal to another Portal, resell or redistribute any part of the Portal, or provide third party access to it.

Non licence: The RACC does not grant any licence or authorisation of any kind for use of its intellectual or industrial property rights, or any other rights related to the Portal or its content.

6. COMPENSATION

Users shall defend, indemnify and hold the RACC, its branches, directors, owners, employees, agents, collaborators, shareholders, business partners and suppliers unharmed by any and all liability, costs, damage and losses caused to them as a result of (i) the users’ use of the Portal, (ii) the users’ breach of the terms of use, (iii) any dispute or litigation between the users and a third party, (iv) user infringement of third party rights.

7. GENERAL

7.1 Communications

All communications to be made between RACC and the users will be directed through the communications function of the Portal.
The RACC’s response will depend on the volume of messages received and the complexity of the issues raised.
The data provided by users in such communications will be processed in accordance with the applicable data protection provisions.

7.2 Applicable law and qualified jurisdiction

The Portal and its conditions of use shall be governed and interpreted by the laws in force in Spain.

The RACC and the users shall make all reasonable efforts to amicably resolve any dispute arising out of or relating to these Terms of Use and/or the Portal.

If the parties should be unable to resolve any dispute, the Courts or Tribunals qualified to resolve them shall be those that correspond according to the regulations and/or contract in force.

7.3 Assignment or transmission

The user rights and obligations on the Portal may not be assigned or transferred, in whole or in part, by users to third parties without the prior consent of the RACC to that effect.

Users hereby authorise the RACC to assign their rights and obligations on the Portal to third parties, exclusively for the purposes indicated in the Privacy Policy section and always in accordance with the provisions of current legislation on data protection.

7.4 Preservation of the legal relationship

If any clause of the Portal or of these terms of use is declared totally or partially null or ineffective, the nullity or ineffectiveness will only affect that provision or that part of it which is null or ineffective. The remaining clauses of the Portal or of the terms of use shall subsist and such provision, or the part of it that is affected, shall be deemed not to have been included unless, being essential to the clauses or terms of use as a whole, it should affect them.

7.5 Single agreement

The terms of use contain the sole agreement between the parties on the subject matter of the legal relationship between them.

Responsible for processing: Your personal data are processed by Real Automóvil Club de Cataluña (RACC GROUP). You can contact the RACC Data Protection Delegate at the following address: dporacc@racc.es.

Purpose of the processing: Personal data will be processed for the purposes of video surveillance and security of persons, goods and facilities.

Legitimisation of the processing: The processing of your personal data is carried out on the basis of legitimate interest in the protection of persons, goods and facilities of the RACC.

Recipients: If requested, the images may be communicated to Judges or Courts or to the State Security Forces and Bodies that request the recordings. This communication is based on the fulfilment of a legal obligation and the prevention of crimes.

Preservation of the Data: The images shall be deleted no later than one month after they are taken, unless they are required to be retained by the authorities. Recording systems shall be located in a guarded or restricted-access location, and only authorised personnel shall have access to the images.

Rights: You may exercise the following rights: access, erasure and restriction of the data processing by addressing the Data Protection Controller at the RACC, sending an e-mail to: dporacc@racc.es.; or by post to: Avenida Diagonal, 687- 08028 Barcelona (A/A. Delegado de Protección de Datos del RACC). You will have to submit a copy of your Personal ID or official document.

SERVIHOGAR GESTIÓN 24HORAS, S.L.U., a RACC Group company that provides technical assistance, repairs, installations and home improvement services, with C.I.F. B-66774183 and address at Av. del Vents, 9, 5ª de BADALONA, as the party responsible for the processing of your data, will use the data provided to provide the service requested and to monitor it by any means, including electronic means.

We will carry out this processing on the basis of your service request.
